This is how it starts, go after the little guy, charge them for a license, put them out of business. Given that I'm NOT a lawyer and have no experience with American law, my first thought is... Does she actually need an auctioneers licence as technically she's NOT the auctioneer - eBay is, how is what she's doing different to anybody actually going into a tradtional auction house and asking to use the auction house services to sell items for a profit (minus the auction houses cut). I wonder if eBay has an auctioneers licence - now THAT would make for an interesting case, still it sucks when some little jumped up official get's their knickers-in-a-twist (or panties-in-a-wad for you Yanks) and decides to take it out on the little guy (or gal)... Given that I’m NOT a lawyer and have no experience with American law, my first thought is…

Does she actually need an auctioneers licence as technically she’s NOT the auctioneer – eBay is, how is what she’s doing different to anybody actually going into a tradtional auction house and asking to use the auction house services to sell items for a profit (minus the auction houses cut).
